Jeremy is an experienced commercial litigator who has litigated, tried, and handled appeals of cases across a wide variety of industries and in numerous state and federal courts and arbitrations.
The majority of Jeremy’s career has been devoted to representing lawyers and law firms in complex, high-stakes professional-liability matters, including claims of legal malpractice, breaches of fiduciary duty, and DTPA violations, as well as advising clients on conflicts and attorney disciplinary issues. Jeremy is honored that some of the most successful and experienced lawyers and law firms across the country look to him for counsel and representation when they need it most.
In addition to his Law Firm Defense practice, Jeremy also routinely represents clients in a wide variety of commercial disputes, including bankruptcy/restructuring litigation matters and energy-related matters.
Law Firm Defense
(U.S. Fifth Circuit; U.S. District Court, E.D. Tex.) – Obtained dismissal on the basis of attorney immunity on an interlocutory appeal which reversed trial court and rendered judgment in favor of Am. Law 100 law firm against a negligent-misrepresentation claim by a client’s excess insurer arising out of the law firm’s litigation updates to the insurer
(Tex. Dist. – Harris County) – Obtained summary judgment on plaintiff’s litigation-malpractice claims against Am. Law 100 law firm and one of its lawyers arising from an underlying divorce proceeding, including judgment on law firm’s counterclaim for unpaid attorneys’ fees
(JAMS Arbitration; Tex. App. – Dallas) – Obtained summary disposition in favor of a national law firm and one of its lawyers, which dismissed claims by plaintiff who alleged he was law firm’s client and had suffered damages arising out of law firm’s representation of plaintiff’s former company in a mediation, awarded the law firm over $500,000 in attorneys’ fees, and subsequently was enforced by the district court and affirmed by the court of appeals
(Tex. App. – Dallas; Tex. Dist. – Dallas County) – Obtained summary judgment for an Am. Law 200 law firm on legal-malpractice and negligent-misrepresentation claims arising from a non-judicial foreclosure of commercial real-estate, which was affirmed by the court of appeals
(Tex. Dist. – Travis County) – Defended Am. Law 100 law firm in a suit by former client arising from pre-transaction antitrust advice leading to an FTC divestiture and involving over $80 million in claimed damages
(Tex. Dist. – Hays County) – Defended Am. Law 100 law firm against former client alleging conflicts of interest arising from law firm’s prior securities-law advice and seeking over $500 million in purported damages
(AAA Arbitration) – Defended Am. Law 100 law firm against claim by former client that law firm purportedly caused client to suffer death-penalty sanctions in underlying litigation
(Tex. Dist. – Dallas County) – Defended Am. Law 100 law firm and individually-named attorneys against claim that law firm committed errors in drafting real-estate financing documents and in a subsequent bankruptcy proceeding
(Tex. Dist. – Harris County) – Represented law firm and individually-named attorneys against claim that law firm’s alleged failure to raise an argument in a motion to compel arbitration led to an adverse ruling against the client and a string of copycat suits against the client
(Pre-Suit Mediation) – Represented Am. Law 100 law firm and individually-named attorneys against threatened claim by SEC-appointed receiver alleging that law firm should have advised former client about securities-fraud scheme
(Pre-Suit Mediation) – Represented Am. Law 100 law firm against claim that law firm allegedly erred in drafting termination provisions for an asset purchase agreement
(Bankr. S.D. Tex.) – Represented ceramic proppant company as debtor-in-possession in successfully defeating motion to appoint an equity committee and obtaining confirmation of a contested chapter 11 plan of reorganization
(Bankr. D. Del.) – Represented coal-mining company as debtor-in-possession in contested bankruptcy proceedings
(Bankr. N.D. Tex.) – Represented local fast-casual restaurant chain as debtor-in-possession in contested bankruptcy proceedings
(Bankr. S.D. Tex.) – Represented E&P oil-and-gas company as debtor-in-possession in contested bankruptcy proceedings
(Bankr. D. Del.) – Represented private-equity sponsor of an E&P oil-and-gas company in contested chapter 11 bankruptcy proceedings
(Tex. Dist. – Collin County) – Secured take-nothing summary judgment on Texas Securities Act claims and other tort claims against E&P oil-and-gas company as well as affirmative summary judgment on counterclaim against plaintiff for breach-of-contract and payment of attorneys’ fees
(N.D. Tex.) – Obtained partial defense verdict for major software company after a two-week jury trial in a trade-secret misappropriation case
(JAMS Arbitration) – Represented solar-energy company in one-week arbitration trial arising out of an alleged breach of incentive-payment provisions in separation agreements
(Del. Ch.) – Represented private-equity firm against allegations of aiding and abetting an alleged breach of fiduciary duty by directors of a public company
