Vinson & Elkins' Energy Transition & Inflation Reduction Act Conference

Vinson & Elkins' Energy Transition & Inflation Reduction Act Conference

On November 7, Vinson & Elkins hosted an Energy Transition and Inflation Reduction Act (IRA) Conference in its New York office. This program brought together leaders from the legal, financial, and energy sectors to provide an overview of current trends, insights and challenges in the clean energy market, and a breakdown of the IRA’s impact on the energy sector. Given its timing immediately following the election, the program provided a real-time discussion on potential developments for the remainder of 2024 and into 2025. Bringing together over 200 professionals across various industries and backgrounds, the high level of engagement underscored the importance and relevance of the discussions.

Below is an overview of what our panelists covered. Please don’t hesitate to reach out to Caroline Mizell with questions to further discuss.

  • Tax Credit Transfer Market Updates and Trends: Panelists unveiled the major forces and key players shaping the tax credit transfer market and explored the winners and losers of the IRA’s tax provisions, the availability of financing for tax credits, and the impact of the presidential election on the market.
  • How Tax Insurance Policies are Underwriting IRA Credits: With an exponential growth in tax insurance submissions, panelists discussed how tax insurance policies are underwriting IRA credits and highlighted the commonly insured risks for the IRA’s tax credits.
  • Private Equity’s Role in the Energy Transition: In light of the IRA’s tax incentives and direct pay options, panelists examined private equity and alternative investors’ pivotal role in financing the energy transition, navigated the landscape of investments opportunities, and considered current deal trends in the market.
  • Tax Inquiries, Audits and Regulatory Challenges – What Should We Expect?: This panel analyzed the implications of the IRA’s enhanced funding and enforcement for the IRS, and reviewed the status and outlook of the regulatory guidance for the IRA’s tax credits and the impact of the Supreme Court’s decision to overturn the Chevron doctrine.
  • A Hot Take on the Impact of the Election – What Does it Mean for the IRA?: Panelists evaluated the impact of the 2024 presidential election on the IRA and the energy transition and assessed the likelihood and implications of potential legislative changes, including modifications, extensions, or repeals of tax credits.
  • The Energy Transition’s Impact on Capital Markets: Panelists addressed the challenges and risks for investors as they consider deploying capital and further explored the effect of the energy transition and the IRA on capital markets, including the anticipated impact of the 2024 presidential election.
