Practitioners in common law jurisdictions have traditionally eschewed the allure of a general concept of good faith, but have developments in recent years moved the needle? How do we see good faith arguments deployed in cross-border construction disputes, and how do tribunals reconcile the differences in approach between common and civil legal system in international construction projects? Through reference to illustrative examples, the day will cover these and a number of other key themes of relevance, including the role of an engineer in large EPC contracts and the use of mediation during the project execution stage.
