Mackenzie is a commercial litigator with a focus on antitrust litigation, including business-to-business disputes and class actions. She also has experience in a range of commercial disputes, including cases involving securities, contract, and tort claims. She has represented both plaintiffs and defendants in state and federal litigations.
Mackenzie also maintains an active pro bono practice, often representing incarcerated people who have been denied parole in appeals to the Parole Board and, if unsuccessful, filing Article 78 petitions on their behalf in New York state courts.
Experience Highlights
Representing a major healthcare system in a case alleging a conspiracy among commercial insurance companies to depress out-of-network reimbursements to healthcare providers
Representing a property management company in a class action alleging the existence of a conspiracy to increase the price of apartments using a common algorithm
Representing a real estate agency in a class action alleging price-fixing of brokers’ commissions in coordination with a trade association
Assisted in securing complete dismissal of a securities fraud class action against a multinational consumer goods corporation alleging misstatements and omissions regarding a subsidiary in its securities filings
Assisted in obtaining dismissal followed by a favorable settlement of a putative class action against entities alleged to operate a cryptocurrency platform in a case involving claims of intentional and negligent misrepresentation and negligence
Assisted in a successful appeal to the First Department, securing dismissal of a case involving a claim of aiding and abetting breach of fiduciary duty against broker defendants alleged to have provided “sham” quotes to employees of a defunct hedge fund
